These Terms of Service (“Terms”) govern access to and use of JamesBnB, including the website at https://jamesbnb.com, the web application, the mobile application, and related services (the “Service”).

(“JamesBnB”, “we”, “us”, or “our”).
By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Who may use the Service
The Service is a business tool for hosts, property managers, and vacation-rental teams.
You represent that:
- you are at least 18 years old;
- you have authority to bind the business entity you represent (if any); and
- you will use the Service only for lawful business purposes.
Consumers using JamesBnB as an end guest of a stay are not the intended users of the Service.
2. Accounts and security
You must provide accurate registration information and keep your credentials confidential. You are responsible for activity under your account.
Notify us promptly at [email protected] if you suspect unauthorized access.
We may suspend or terminate accounts that are inactive, insecure, abusive, or in breach of these Terms.
3. The Service
JamesBnB helps property managers manage guest communication and related operations. Features may include:
- syncing booking and message data from connected channels (for example Airbnb and Booking.com notification emails);
- WhatsApp and email messaging workflows;
- AI-assisted drafting, translation, enhancement, and manager assistant features;
- property/listing organization and operational settings;
- mobile push notifications for relevant events.
Features may change, be limited during early access/beta, or differ between web and mobile.
No professional advice. The Service does not provide legal, tax, compliance, or platform-policy advice.
4. AI-assisted features
Some features use artificial intelligence (including Google Vertex AI / Gemini) and related observability tools.
You acknowledge that:
- AI outputs may be inaccurate, incomplete, outdated, or inappropriate for a specific guest situation;
- you remain responsible for your guest communications, approvals, training-mode choices, and final decisions;
- where auto-send or similar modes are enabled, you accept the risk of automated outbound messages under your account and channel configuration;
- we may process conversation content to generate replies, translations, embeddings, and quality traces as described in our Privacy Policy.
Do not rely on JamesBnB as the sole safeguard for emergencies, safety-critical instructions, legal commitments, refunds, or discrimination-sensitive decisions without human review appropriate to your business.
5. Channel connections and your content
5.1 Authorizations you grant
By connecting a mailbox, WhatsApp account, listing platform, calendar feed, or similar integration, you authorize us to access, process, store, and transmit the related data as needed to provide the Service.
You represent that you have all rights and consents required to grant that access and to process guest personal data through JamesBnB.
5.2 Your responsibilities as data controller for guest data
For guest and booking personal data processed through your integrations, you are generally the controller and JamesBnB is your processor, as further described in the Privacy Policy. You are responsible for:
- lawful bases and guest notices;
- platform terms (Airbnb, Booking.com, Meta/WhatsApp, Google, etc.);
- the accuracy of property knowledge you store; and
- deciding which messages are approved or auto-sent.
5.3 Your content
“Customer Content” means data you submit or connect to the Service, including account data, property knowledge, mailbox content, guest messages, and settings.
You retain ownership of Customer Content. You grant us a worldwide, non-exclusive license to host, process, transmit, display, and create derivative works from Customer Content solely to provide, secure, maintain, and improve the Service (including AI inference, retrieval embeddings, and operational monitoring).
You must not upload or instruct the Service to send unlawful, infringing, deceptive, discriminatory, or harmful content.
6. Acceptable use
You agree not to:
- reverse engineer, disrupt, or overload the Service except as permitted by mandatory law;
- probe or bypass security or access controls;
- use the Service to spam, phishing, or unlawfully contact individuals;
- misrepresent your identity or relationship to a property;
- use the Service for anyone under 18 as an account holder;
- resell or provide the Service to third parties as a competing hosted offering without our written consent; or
- use the Service in violation of applicable law or third-party platform rules.
We may investigate suspected violations and remove content or suspend access.
7. Early access, betas, and changes
Parts of the Service may be offered as waitlist, early access, or beta features, provided as available, possibly with reduced support, incomplete documentation, or breaking changes.
We may modify, suspend, or discontinue features with reasonable notice where practicable. We have no obligation to maintain any particular feature indefinitely.
8. Fees
Paid subscription billing is not currently enabled in the product. If we introduce paid plans, pricing, invoicing, taxes, and renewal terms will be presented before purchase and may update these Terms or an order form.
During free/early access use, the Service is provided without charge and without a service-level commitment unless we agree otherwise in writing.
9. Intellectual property
JamesBnB, including software, models configuration, prompts we create, branding, and documentation, is owned by S’living GmbH or its licensors. These Terms do not transfer ownership to you.
Feedback you provide may be used by us without obligation to you.
10. Privacy
Our processing of personal data is described in the Privacy Policy. By using the Service, you acknowledge that Policy.
11. Third-party services
The Service depends on third parties (for example Google, Meta, Expo/Apple/Google push services, Cloudflare, channel platforms). We are not responsible for third-party outages, policy changes, or decisions outside our reasonable control. Your use of those services may be subject to their own terms.
12. Disclaimers
To the maximum extent permitted by applicable law, the Service is provided “as is” and “as available”, without warranties of any kind, whether express, implied, or statutory, including merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, or error-free operation.
We do not warrant that AI-generated content will be correct, complete, or suitable for any specific guest interaction.
13. Limitation of liability
To the maximum extent permitted by applicable law:
- we are not liable for indirect, incidental, special, consequential, punitive, or lost-profit damages, or for loss of data, goodwill, or business interruption;
- our aggregate liability arising out of or relating to the Service or these Terms is limited to the greater of (a) the amounts you paid us for the Service in the 12 months before the claim, or (b) EUR 100 if you have not paid any fees.
Nothing in these Terms limits liability that cannot be limited under German law, including liability for intent, gross negligence, injury to life, body, or health, or mandatory product liability.
14. Indemnity
You will defend and indemnify S’living GmbH against claims, losses, and expenses (including reasonable legal fees) arising from:
- your Customer Content;
- your guest communications and channel configurations;
- your breach of these Terms or applicable law; or
- disputes between you and guests, platforms, or other third parties,
except to the extent caused by our willful misconduct or gross negligence.
15. Suspension and termination
You may stop using the Service at any time. To request account deletion, email [email protected].
We may suspend or terminate access immediately if you breach these Terms, create risk to the Service or others, or if required by law or a platform partner.
Upon termination, your right to use the Service ends. Sections that by nature should survive (including IP, disclaimers, liability limits, indemnity, and governing law) will survive.
16. Governing law and disputes
These Terms are governed by the laws of the Federal Republic of Germany, excluding conflict-of-law rules.
Courts in Stuttgart, Germany shall have exclusive jurisdiction, unless mandatory law provides otherwise (for example for consumers, which are not the intended users of the Service).
Before filing a claim, you agree to contact us at [email protected] and attempt to resolve the dispute informally within 30 days.
17. Changes to these Terms
We may update these Terms from time to time. We will post the updated Terms on this page and update the “Last updated” date. For material changes, we will provide reasonable notice where practicable (for example by email or in-product notice).
Continued use after the effective date constitutes acceptance of the updated Terms, except where mandatory law requires a different process.
18. General
If a provision is unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. These Terms are the entire agreement regarding the Service and supersede prior conflicting terms on the same subject, except a separately signed written agreement that expressly prevails.
You may not assign these Terms without our consent; we may assign them in connection with a corporate transaction.
